Please read this agreement carefully. It applies to your child's participation in any activity, class, or event booked through The Village. This waiver is signed once and covers all Village coordinated activities going forward.

1. Assumption of Risk. I understand that participation in activities, classes, and events booked, scheduled, or facilitated through The Village Palm Beach LLC ("The Village"), including but not limited to swim lessons, sports, karate, dance, gymnastics, art, music, tutoring, childcare, pet care, and special events (collectively, "Activities"), carries inherent risks. These risks include, but are not limited to, physical injury, illness, property damage, and in rare cases, serious injury or death, whether arising from the activity itself, the conduct of other participants or instructors, equipment or facility conditions, or other causes. I voluntarily assume these risks on behalf of my child or children ("Participant(s)").

2. Release and Waiver of Liability. To the fullest extent permitted by Florida law, I release, waive, discharge, and agree not to sue The Village Palm Beach LLC, its owners, members, officers, and employees, and any affiliated independent instructors, vendors, or third party activity providers made available through The Village (collectively, the "Released Parties"), from any and all liability, claims, demands, or causes of action arising out of or related to the Participant(s)' participation in the Activities, whether caused by the negligence of the Released Parties or otherwise, except to the extent caused by gross negligence or willful misconduct.

3. Parental Indemnification. Because Florida law limits a parent's ability to waive a minor child's own right to bring a claim, I additionally agree, in my individual capacity, to indemnify and hold harmless the Released Parties from any claim brought by or on behalf of the Participant(s) arising from the Activities, to the fullest extent permitted by law.

4. Medical Authorization. I authorize The Village and its staff, instructors, and caregivers to seek emergency medical treatment for the Participant(s), including calling 911 and arranging transport, if I cannot be reached. I am responsible for any resulting medical costs, and I agree to keep The Village informed of my child's medical needs through the Child & Family Information Sheet.

5. Photo and Video Release. I grant The Village permission to take photos and videos of the Participant(s) during Activities and to use them in Village materials (website, social media, marketing). I may opt out of this below at any time without affecting my child's ability to participate.

6. Booking Through The Village. I understand that The Village introduces my family to its sitters, nannies and caregivers ("Village Caregivers"). All future bookings with any Village Caregiver my family meets through The Village, including babysitting, date nights, occasional sitting, childcare and nanny positions, will be made through The Village. For 18 months after my family first meets a Village Caregiver through The Village, I agree not to hire, book or pay that caregiver directly or through another agency, app or platform, and not to refer them to another family for that purpose. If my family wishes to hire a Village Caregiver as an ongoing nanny, I will do so through The Village's Nanny Placement Agreement. If I book or hire a Village Caregiver outside The Village, I agree to pay The Village a fee of $2,500 or the placement fee that would apply under The Village's Nanny Placement Agreement, whichever is greater.

7. Cancellation Policy. I agree to The Village's cancellation policy, as posted at thevillagepalmbeach.com.

8. Governing Law. This agreement is governed by the laws of the State of Florida, and any dispute arising from it will be resolved in Palm Beach County, Florida.

By signing below, I confirm that I am the parent or legal guardian of the Participant(s) listed, that I have read and understood this agreement, including the booking and cancellation terms in Sections 6 and 7, and that I sign it freely and voluntarily on behalf of myself and the Participant(s).
